Justice and Reality: Think Like a Lawyer
Zhan Qingyun
Zhan Qingyun:Hello, I’m Zhan Qingyun.
Pang Ying:Hello, I’m Pang Ying.
Zhan Qingyun:Seeing my good friend Pang Ying again means another debate. Last time we introduced American Factory through law and explained legal background suggested by the documentary.
We saw how American unions’ historical position continually changes with social priorities and struggles among groups.
The film offers much more to discuss. Today we may move beyond law and consider institutions, the documentary itself, and what it inspired.
Many interesting reviews already exist. Our distinctive contribution will again be debate. Watching together, we strongly disagreed about its center and meaning. Our motion is: Was the American factory a blessing or exploitation? I defend ‘blessing.’
Pang Ying:I defend ‘exploitation.’
Zhan Qingyun:I put ‘blessing’ in quotation marks because the word itself sounds ingratiating.
Pang Ying:My ‘exploitation’ needs no quotation marks.

Affirmative: A Job Is Itself a ‘Blessing’

Zhan Qingyun:Let us begin by defining exploitation. Under Marx’s definition—extracting workers’ surplus value—capitalism exploits constantly.
Pang Ying:I will not call every extraction of surplus value exploitation, because nearly all commerce would qualify. I mean conduct that goes too far, crosses a baseline, and ought to be eliminated, reduced, or opposed.
Zhan Qingyun:Then my ‘blessing’ means the factory is good despite imperfection, many problems, and conditions inferior to the past. For the Americans it employs, it remains beneficial.
The old days will not return. Workers acknowledge that earning $24 an hour at GM is gone and Fuyao pays $12. But employment provides income, purpose, and a way to realize value. Is that not still good?

Negative: Is a Sweatshop Job Really a ‘Blessing’?

Pang Ying:The affirmative quietly performs several tricks. First, she limits the question to Fuyao’s local American workers and divides the working class into separate groups with separate interests—a classic capitalist strategy that prevents class solidarity.
