宪法的地位：规范主权的根本大法

我们讲到《美国宪法》，它的文本很重要的是前面有一个序言（Preamble）。不过认真地计较，那序言（Preamble）并不是《美国宪法》真正的开头。因为在序言之前还有什么呢？还有标题：THE CONSTITUTION OF THE UNITED STATES（《美国宪法》）。
200多年来，太多国家都通过、都建立了自己的宪法，就给了我们一种对于宪法的熟悉，以至于往往我们就忘了要探问：Constitution（宪法）这个英文字究竟是什么呢？
《美国宪法》的前身、后来被《美国宪法》取代的是前面跟大家提过的《邦联条例》，那叫做Articles of Confederation。
由费城会议起草的《美国宪法》，一共包括7条。这7条它的原文是从Article I一直排到 Article VII。换句话说，这份文件的实质内容也就是Articles of the United States（“合众国条款”）。原本管辖邦联的条款被后来管辖联邦的条款给取代了，这样不就是理所当然？为什么这份文件没有沿袭这个名字the Constitution of the United States，而是改称“Constitution”？
选用这个字背后的理由，就牵涉到公民10堂课中的第2堂，那是关于卢梭的理论。
在谈卢梭《社会契约论》的节目当中跟大家介绍过，卢梭他曾经为波兰和科西嘉岛订定了立国大法，而卢梭他所命名采用的名称就是“宪法（Constitution）”。在卢梭的著作当中就清楚地定位宪法（Constitution）是规范主权的。

    正文第四段“原本管辖邦联的条款被后来管辖联邦的条款给取代了，这样不就是理所当然？为什么这份文件没有沿袭这个名字the Constitution of the United States，而是改称“Constitution”？”里“the Constitution of the United States”可能是编辑笔误了，应改为“Articles of the United States”。

    这倒是一个场外民意倒逼场内政治谈判的例子，也看得出有时不公开有不公开的好处。公开了，就没有回头路了，就会尽量避免出尔反尔，而一条路走到黑，无法谈判和妥协。
